Welcome to yaNkap! By registering for and using our digital wallet services, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.
1. Acceptance of Terms
By creating a yaNkap account, downloading our mobile application, or using any of our services, you agree to:
- Be bound by these Terms of Service
- Comply with our Privacy Policy
- Follow all applicable laws and regulations
- Accept updates to these terms as they are modified
If you do not agree to these terms, you may not use yaNkap services.
2. Eligibility Requirements
To use yaNkap, you must:
- Be at least 18 years of age
- Be a resident of Cameroon or an authorized jurisdiction
- Have a valid government-issued identification document
- Have a valid mobile phone number
- Pass our Know Your Customer (KYC) verification process
- Not be prohibited from using financial services under any applicable law
3. Account Registration and Security
3.1 Account Creation
When you register for a yaNkap account, you must:
- Provide accurate, complete, and current information
- Complete the KYC verification process
- Create a secure PIN and password
- Maintain and promptly update your account information
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your PIN, password, and other security credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Keeping your registered mobile device secure
Important: Never share your PIN, password, or OTP (One-Time Password) with anyone. yaNkap staff will never ask for these credentials.
3.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms of Service
- We suspect fraudulent or illegal activity
- You provide false or misleading information
- You fail to complete or update KYC verification
- Required by law or regulatory authorities
4. Services Offered
4.1 Wallet Services
yaNkap provides a digital wallet that allows you to:
- Store funds electronically
- Send and receive money (P2P transfers)
- Top-up mobile airtime
- Pay bills (utilities, subscriptions, etc.)
- Join and participate in Nkáp (tontine) groups
- View transaction history and account statements
4.2 Transaction Limits
Transaction limits apply based on your account verification level:
- Basic Account: Daily transaction limit of 500,000 XAF
- Verified Account: Daily transaction limit of 2,000,000 XAF
- Premium Account: Daily transaction limit of 5,000,000 XAF
We reserve the right to modify these limits at any time for security or regulatory reasons.
5. Fees and Charges
5.1 Transaction Fees
yaNkap charges fees for certain services:
- P2P Transfers: 0.5% - 1.5% depending on amount
- Cash-out to Bank: 1% + 200 XAF
- Cash-out to Mobile Money: 1.5% + 100 XAF
- Bill Payments: Free to 100 XAF service charge
- Airtime Top-up: Free
Current fees are displayed in the app before you confirm each transaction. We may update fees with 30 days' notice.
5.2 Currency and Exchange Rates
All transactions are processed in Central African Francs (XAF). If you send money to or receive money from other currencies, exchange rates will apply as displayed in the app at the time of transaction.
6. Prohibited Activities
You may NOT use yaNkap to:
- Engage in any illegal activity, including money laundering, terrorism financing, or fraud
- Purchase illegal goods or services
- Impersonate another person or entity
- Interfere with or disrupt our services
- Use automated tools, bots, or scrapers to access the platform
- Attempt to gain unauthorized access to our systems
- Share your account with other users
- Engage in any activity that violates these Terms of Service
Consequences: Violation of prohibited activities may result in immediate account suspension, fund freezing, legal action, and reporting to authorities.
7. Transactions and Refunds
7.1 Transaction Processing
When you initiate a transaction:
- You authorize us to deduct the transaction amount plus applicable fees from your wallet
- Transactions are typically processed instantly, but may take up to 24 hours in some cases
- Once confirmed, transactions cannot be cancelled
- You will receive a transaction receipt and notification
7.2 Failed Transactions
If a transaction fails:
- Funds will be automatically returned to your wallet within 24-48 hours
- You will be notified via SMS and push notification
- Fees for failed transactions will be refunded
7.3 Disputes and Chargebacks
If you believe a transaction was unauthorized or erroneous:
- Contact our support team within 7 days of the transaction
- Provide transaction details and evidence
- We will investigate and respond within 14 business days
- Decisions are made at our sole discretion
7.4 Refund Policy
Refunds are issued only for:
- Failed transactions
- Duplicate charges due to system error
- Unauthorized transactions (subject to investigation)
- Service errors on our part
Note: Completed and correctly processed transactions are generally non-refundable.
8. Nkáp Groups (Tontines)
8.1 Group Participation
When you join or create a Nkáp group:
- You agree to the group's rules and contribution schedule
- You must make timely contributions as agreed
- Payouts are processed according to the group's rotation cycle
- You can leave a group only after completing your payout cycle
8.2 Group Liability
yaNkap acts as a platform facilitator for Nkáp groups. We:
- Process contributions and payouts automatically
- Hold funds securely until payout
- Do NOT guarantee member participation or payment
- Are NOT responsible for disputes between group members
By joining a group, you acknowledge that you participate at your own risk.
9. Intellectual Property
All content, trademarks, logos, and intellectual property on the yaNkap platform are owned by yaNkap or our licensors. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks or branding for any purpose
- Reverse engineer or decompile our software
- Create derivative works based on our platform
10. Limitation of Liability
To the maximum extent permitted by law:
- yaNkap is provided "AS IS" without warranties of any kind
- We do not guarantee uninterrupted or error-free service
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount of fees you paid in the last 12 months
- We are not responsible for third-party services or payment failures beyond our control
11. Indemnification
You agree to indemnify and hold harmless yaNkap, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of our services
- Your violation of these Terms of Service
- Your violation of any law or third-party rights
- Unauthorized use of your account
12. Privacy and Data Protection
Your use of yaNkap is also governed by our Privacy Policy. By using our services, you consent to:
- Collection and processing of your personal information
- Use of your data as described in the Privacy Policy
- Sharing of information with service providers and regulatory authorities
13. Compliance and Regulatory
13.1 KYC/AML Compliance
yaNkap complies with Know Your Customer (KYC) and Anti-Money Laundering (AML) regulations. We:
- Verify the identity of all users
- Monitor transactions for suspicious activity
- Report suspicious transactions to authorities
- May request additional documentation at any time
13.2 Tax Obligations
You are responsible for:
- Understanding and complying with your tax obligations
- Reporting income and transactions as required by law
- Paying applicable taxes on your yaNkap activity
We may report your transaction information to tax authorities as required by law.
14. Changes to Terms
We may modify these Terms of Service at any time. When we make material changes:
- We will notify you via email or in-app notification
- Changes take effect 30 days after notification
- Continued use after changes constitutes acceptance
- You may close your account if you disagree with changes
15. Dispute Resolution
15.1 Informal Resolution
If you have a dispute, please contact our customer support first. We will work with you to resolve issues informally.
15.2 Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration in Douala, Cameroon, under the rules of the Cameroon Arbitration Association.
15.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class action lawsuits.
16. Governing Law
These Terms of Service are governed by the laws of:
- The Republic of Cameroon
- CEMAC (Central African Economic and Monetary Community) regulations
- COBAC (Banking Commission of Central Africa) directives
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18. Force Majeure
yaNkap is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including:
- Natural disasters
- Government actions or regulations
- War, terrorism, or civil unrest
- Power outages or telecommunications failures
- Cyber attacks or security breaches affecting third parties
